Terms of Service

These Terms of Service ("Terms") govern your use of MoMo ("MindfulCoach Pro"), a product of Fusion Labs Project ("we," "us," or "our"). By creating an account or using MoMo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

MoMo is an AI-powered companion designed for mindfulness, journaling, and coaching support. The service includes:

• Voice and text-based conversations with an AI companion.
• Conversational memory that persists across sessions.
• Optional health data integration (Apple HealthKit) for contextual insights.
• Tools such as breathing exercises, mood check-ins, and journaling prompts.

MoMo is available as both a personal mindfulness tool (B2C) and a professional coaching platform (B2B) for practitioners to extend client engagement.

You must be at least 18 years old to use MoMo. By creating an account, you represent that you meet this age requirement.

You may create an account using an email magic link, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

Plans

MoMo offers a free tier with limited features and a paid subscription. Paid plans are billed either monthly or annually, as selected at the time of purchase.

Billing

Payments are processed securely by Stripe. By subscribing, you authorize us to charge the payment method on file at the start of each billing cycle. All amounts are in USD unless stated otherwise.

Cancellation

You may cancel your subscription at any time through the app or by contacting us. When you cancel, you retain access to paid features until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

Price Changes

We may change subscription pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.

You agree not to:

• Use MoMo for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, decompile, or disassemble any part of the service.
• Use automated tools (bots, scrapers) to access the service without permission.
• Transmit malware, viruses, or other harmful code through the service.
• Impersonate another person or entity.
• Use MoMo to generate content that promotes violence, hatred, or illegal activity.

We reserve the right to suspend or terminate accounts that violate these terms.

MoMo is not a medical device, therapy service, or crisis intervention tool. It is an AI companion designed to support mindfulness and self-reflection. MoMo does not diagnose, treat, cure, or prevent any medical or mental health condition.

While MoMo includes safety features that can detect crisis situations and provide resources, it is not a replacement for professional mental health care. If you are experiencing a mental health emergency, please contact your local emergency services, call the 988 Suicide & Crisis Lifeline (US), or go to your nearest emergency room.

If you are a coaching professional using MoMo with clients, you remain responsible for your professional obligations, duty of care, and clinical judgment.

MoMo, including its design, software, branding, and AI-generated content, is owned by Fusion Labs Project and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for personal or authorized professional purposes.

You retain ownership of the content you input into MoMo (your messages, journal entries, etc.). By using the service, you grant us a limited license to process this content solely to provide and improve the service, subject to our Privacy Policy.

MoMo's responses are generated by artificial intelligence and may not always be accurate, complete, or appropriate. You should exercise your own judgment when considering AI-generated content. We do not guarantee the accuracy, reliability, or suitability of any AI-generated response.

Your data belongs to you. You may export all your data or permanently delete your account at any time through the app or by contacting us. See our Privacy Policy for full details on data handling.

We strive to keep MoMo available at all times but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.

To the maximum extent permitted by law, Fusion Labs Project and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of MoMo. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

MoMo is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may suspend or terminate your access to MoMo at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by deleting it through the app or contacting us. Upon termination, your right to use the service ceases immediately, but you may request a data export before deletion.

We may modify these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of MoMo after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
